Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Dioartis Grup SRL (the "Company", "we", "us", "our"), including web hosting, VPS, reseller hosting, domain registration, and related products (the "Services"). By ordering, accessing, or using the Services, you agree to be bound by these Terms.


1. Company details

2. Definitions

  • Client / You: the person or legal entity purchasing or using the Services.
  • Client Area: the billing/support portal used to manage Services.
  • Content: any data, files, websites, emails, software, or materials you store, transmit, or process via the Services.
  • Acceptable Use Policy (AUP): rules that prohibit abuse, illegal activity, and harmful content (see Section 8).

3. Account eligibility & security

  • You must provide accurate account and billing information and keep it current.
  • You are responsible for all activity under your account, including actions performed by users you authorize.
  • You must keep passwords/API keys secure and notify us immediately of suspected unauthorized access.

4. Services, provisioning & changes

  • Service activation typically occurs after successful payment and fraud screening (where applicable).
  • We may modify, upgrade, or discontinue parts of the Services to improve performance, security, or compliance.
  • We may apply reasonable technical limitations to protect the network and maintain service quality.

5. Billing, renewals & taxes

  • Services are billed in advance for the selected billing cycle (monthly/annual/etc.).
  • Auto-renewal: services may renew automatically unless you disable auto-renew or cancel before the due date.
  • Non-payment: overdue invoices may result in suspension, termination, and/or data removal as described in Section 12.
  • Prices may change upon renewal; we will display the renewal price in the Client Area before payment.
  • Taxes/VAT (if applicable) may be added depending on your billing details and legal requirements.

6. Refunds & money-back guarantee

If a money-back guarantee is advertised for specific plans, the following rules apply unless your order page states otherwise:

  • Eligibility: first-time purchases of shared hosting plans only, within 30 days of the initial order date.
  • Not eligible: domain registrations, domain renewals/transfers, setup fees, licenses, add-ons, VPS/dedicated services, abuse-related suspensions, or payments made after a chargeback/dispute.
  • Method: refunds are issued to the original payment method where possible. Processing times depend on the payment provider.

If some services are excluded from the 30-day guarantee, those exclusions must be clearly stated on the relevant order page.

7. Chargebacks & payment disputes

  • Initiating a chargeback or payment dispute may result in immediate suspension for security and fraud prevention.
  • We may charge reasonable fees related to chargeback handling as permitted by law and payment processors.
  • To resolve billing issues, contact us first so we can investigate and help quickly.

8. Acceptable use (AUP)

You may not use the Services for abusive, illegal, or harmful activities, including (but not limited to):

  • Malware, phishing, credential theft, fraud, or distribution of malicious code.
  • SPAM, unsolicited bulk email, or activities that harm sender reputation or network deliverability.
  • Unauthorized scanning, exploitation attempts, or attacks against any system or network.
  • Copyright/trademark infringement, pirated content, or illegal streaming.
  • Content or activity that violates applicable law or third-party rights.
  • Excessive resource usage that negatively impacts platform stability (see Section 9).

We may suspend or terminate Services to protect our infrastructure, clients, and compliance obligations.

9. Resource usage & fair use

  • Shared hosting is intended for typical website workloads. Continuous high CPU/RAM/IO usage may require optimization or an upgrade.
  • We may temporarily limit, throttle, or isolate workloads that degrade performance for other clients.
  • Reseller and VPS services must not be used to host abusive clients or content that violates Section 8.

10. Backups & data responsibility

  • Unless explicitly included in your plan, backups are provided as a convenience and are not guaranteed.
  • You are responsible for maintaining independent backups of your Content.
  • Restore requests may be limited by retention periods, storage constraints, and technical feasibility.

11. Uptime, maintenance & SLA

  • We aim for high availability, but uninterrupted service is not guaranteed.
  • Planned maintenance may occur; when possible, we will provide notice via the Client Area or a status page.
  • If you offer an SLA (e.g., 99.9%), define the measurement method, exclusions (force majeure, upstream issues, attacks), and the credit request procedure.

12. Suspension, termination & data deletion

  • Suspension: we may suspend access for non-payment, abuse, security risks, legal compliance, or AUP violations.
  • Termination: we may terminate Services for severe or repeated violations or prolonged non-payment.
  • Data deletion: after termination, Content may be removed. We may not be able to recover data once deleted.

13. Domains (ICANN/registry rules)

  • Domain registration, renewal, transfer, and WHOIS are governed by the applicable registry/registrar and ICANN policies.
  • Domain availability is not guaranteed until the registry confirms successful registration.
  • You are responsible for maintaining accurate WHOIS/contact data and renewing domains before expiration.
  • Expired domains may enter redemption/restore periods with additional fees or may become unrecoverable.

14. Third-party services & licenses

Some Services may include third-party software, control panels, or licenses. Your use of those components may be subject to additional terms from the relevant provider.

15. Intellectual property

  • You retain ownership of your Content. You grant us a limited right to host, process, and transmit Content as needed to provide Services.
  • We retain ownership of our website, brand, documentation, and service configurations, except where otherwise stated.

16. Privacy & data protection

Personal data processing is described in our Privacy Policy and (where applicable) our GDPR Compliance page. You agree to comply with privacy laws applicable to your Content and your end-users.

17. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our total liability for any claim related to the Services is limited to the amount you paid us for the affected Service during the three (3) months preceding the event giving rise to the claim (unless local law requires otherwise).

18. Indemnification

You agree to defend, indemnify, and hold harmless the Company from claims, liabilities, damages, and expenses arising from your Content, your use of the Services, or your violation of these Terms or applicable law.

19. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, war, civil unrest, labor disputes, internet backbone failures, upstream provider outages, or large-scale attacks.

20. Governing law & disputes

These Terms are governed by the laws of the Republic of Moldova, unless mandatory consumer protection laws in your country require otherwise. Courts with competent jurisdiction will resolve disputes unless we agree to an alternative process.

21. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest revision. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
